General Terms of Service of Food Trip Go

These general conditions of service (hereinafter “GCS”) apply to all services provided by Food Trip Go di Massimo Piazza, Via Bo ggia 10, 6900 Paradiso (hereinafter “Food Trip Go”).

By requesting a Service you agree to these GCS and their attachments.

1. Definitions
“You”: means the one who requested the Service and is therefore the principal of the Service.

“Traveler”: means the person(s) making the Trip.

“Service”: means the set of directions and advice conveyed for the benefit of the Traveler.

“Travel”: means all trips, visits and activities covered by the Service.

“Price List”: means the Payment for Service that can be consulted in section 5.

“Local providers”: means legal entities that from a civil law perspective locally provide a service for the implementation of the Trip (e.g., transportation, access to an attraction, overnight stay, catering).

“Service Request”: means the request submitted to Food Trip Go in which you specify the content of the Service you wish to receive. It may be made either by completing the contact form on the website www.foodtripgo.com or by subsequent written communication (paper or electronic).

2. Description of Service
The Service offered by Food Trip Go includes:

  • Custom travel itinerary planning
  • Development of the cost estimate
  • Provision of trip materials (itinerary, general information on places of interest, local dishes, other)
  • Identification of points of interest
  • Identification of stays
  • Identification of restaurants
  • Support for booking access to attractions
  • Transportation reservation support

As a Principal, You may choose to avail Yourself of all elements of the Service or only of a portion of them. Should you wish to request only individual elements of the Service, you must explicitly indicate this in your Service Request.

3. Service delivery, communication and provision of travel materials

The Service is provided by the owner of Food Trip Go as well as its employees.

Communications between you and Food Trip Go, as well as between Food Trip Go and the Traveler occur primarily by email, by telephone, by text message or whatsapp, via the contact form on the website www.foodtripgo.com, as well as via zoom, teams or Google Meet.

Transmission of information electronically (e.g., by e-mail or through collaboration platforms, etc.) is generally associated with risks, particularly the risk that unauthorized third parties will become aware of it and manipulate the information or, again, that the delivery will not occur properly.

These risks can be reduced with encrypted transmission, for example by encrypting e-mail attachments or using a secure messaging platform. Food Trip Go does not generally set up an encryption procedure. By accepting these GCS you authorize Food Trip Go to correspond electronically without encrypted transmission, aware of the risks involved.

4. Local suppliers
As part of the Service, Food Trip Go may refer and/or recommend local Suppliers.
Food Trip Go operates the selection of Local Suppliers with the utmost care and to the best of its knowledge. Local Suppliers are chosen based on the following criteria:

  • Preferences expressed by you;
  • Direct experience of Food Trip Go;
  • Publicly available reviews;
  • Directions provided by the Service Providers themselves.

Food Trip Go is not involved in any way in the delivery of the performance of Local Providers, nor does it act as an intermediary between you and Local Providers, or between the Traveler and Local Providers. Food Trip Go can therefore under no circumstances be held liable if the Local Providers do not meet expectations, if the quality of the Local Providers’ performance falls short of expectations, as well as if the Local Providers are unable to deliver the desired service for any reason, including the non-existence of the facility.

In addition, Food Trip Go is not responsible if the contact information of local Providers turns out to be incorrect or, if a website is listed, if access to that website causes problems of any kind for you and/or the Traveler.

5. Payment of the Service
Remuneration for the Service is made in application of the following Price List:

Single person, including one companion: CHF 25.00 / travel day
Second companion: CHF 25.00 / travel day
Third companion: CHF 25.00 / travel day
Additional companions: Price to be determined
All prices are in Swiss Francs and include any VAT.

At the time of the Service Request, Food Trip Go requires a deposit of 10% of the expected remuneration.
The remuneration shall be the subject of a regular invoice made out to you as the principal of the Service.

6. Data protection
By accepting these GCS, you explicitly agree that your personal data will be processed by Food Trip Go in the manner indicated in the Data Protection Notice.

7. Additional provisions

Food Trip Go explicitly disclaims liability for any health problems or injuries attributable to the Trip, as well as unforeseeable events such as loss of luggage, theft, and other adverse experiences suffered during the Trip.

8. Applicable law and forum
The provision of the Service is governed by Swiss law, and in particular by the mandate rules in Articles 394 et seq. of the Code of Obligations.

Any dispute arising in connection with the Service shall be subject to the jurisdiction of the courts at the court of Lugano, Switzerland.

INTRODUCTION

This Data Protection Notice explains how Food Trip Go (hereinafter “Company”) processes personal data collected when using the website and by providing the offered services.

“Data processing” is considered to be any kind of personal data management, such as collection, storage, use, disclosure, modification, archiving or deletion. The Company puts in place security measures on a technical and organizational level to ensure that personal data is protected against the risk of loss, inaccurate modification or unauthorized access by third parties. When processing personal data, we comply with Swiss data protection and telecommunication regulations.

Our website may contain external links that are not related to us in any way. Since we are unable to exercise any control over external behavior we disclaim any responsibility for the processing of personal data of this kind by third parties.

PROCESSED PERSONAL DATA

  1. When using the website

While browsing the website, our system automatically records data and information of the computer system of the retrieving device. Our website therefore performs a passive collection of the following data:

  • IP (Internet Protocol) address of the user;
  • User’s Internet Service Provider;
  • User’s operating system;
  • Information about the used type of browser and version;
  • Date and time of access;
  • Pages visited on our website;
  • Web sites from which the user’s system was directed to our Internet page;
  • Web sites retrieved from the user’s system through our Web site.

Additionally, we also collect personal information that the user voluntarily makes available to us by using the website and our services (active collection). For example, when sending a specific request.

  1. In relation to the provision of the offered services

As part of the service mandate, Food Trip Go processes the following personal data:

  • Principal/traveler data and data aimed at mandate management: number of travelers/pairs, first name, last name, date of birth, gender, e-mail address, phone number, special needs (e.g., food intolerances, health problems, mobility difficulties, and the like), complete address, travel dates, travel destinations, main interests of the travel (e.g., monuments, gastronomy, nightlife, and the like), accommodation preferences, and other basic information from publicly accessible sources., who gave our references, content of the requests and mandate, as well as other information needed to identify the principal.
  • Mandate-related data: communications with the principal concerning his or her preferences in relation to the Service, travel documentation, information transmitted during the mandate, principal’s evaluation of the travel.
  • Service and billing data: information on services provided and billed, billing data, list of services, invoices, payments, bank details.
  • Additional information: any additional information provided by the principal.

PURPOSE OF DATA PROCESSING

  1. When using the website

The data collected is necessary to enable proper usability of our website, as well as to answer any questions transmitted by the user.

Automatically recorded data are used for the administration and optimization of the site itself.

We also process data in an anonymous format for statistical purposes. No data analysis for marketing purposes is performed in this context.

  1. In relation to the provision of the offered services

Personal data are processed primarily for the purpose of providing, documenting, billing, and improving the service. Personal data of principals are as well processed to communicate with them, to respond to their inquiries, and to send them information about Food Trip Go.

If you do not wish to receive communications, you can notify the person in charge of data processing.

STORAGE OF PERSONAL DATA

Storage and processing of personal data continue as long as the purpose for which they are collected subsists and to the extent that this is required or permitted by law or contractual provisions.

If data are not deleted because they are needed for legal reasons, their processing is restricted. This means that the data are blocked and are not processed for other purposes. This is especially true for data that must be kept for accounting or tax reasons or other legal obligations.

INFORMATION SHARING

The Company does not sell or give away collected information to third parties for a fee.

We may entrust third parties to perform functions on our behalf, particularly IT service providers and other service providers who, at our request, provide IT applications (e.g., collaboration platforms), support services, and other services for the purposes specified in this Data Protection Notice. These third parties will have access to the above information as necessary to perform the task entrusted to them, but may not use it for any other purpose.

The Company does not use or disclose any personal information without your prior consent, except in cases where it is compelled to do so by law. In particular, information may be transmitted to both Swiss and foreign authorities in execution of corresponding administrative decisions or binding edition requests.

With the explicit acceptance of this Data Protection Notice, the Company is authorized to transmit to its business partners in the territory the following personal data, collected in connection with the provision of the offered services:

-full address.

USE OF COOKIES

Our website uses essential cookies to ensure its proper functioning and tracking cookies to understand how you interact with it.

Insofar as the processing is based on the data subject’s consent, the data subject has the right to withdraw his or her consent at any time with effect for the future as well.

In addition, other rights conferred by the applicable data protection law can be invoked.

To exercise these rights, the data subject may contact the person in charge of data processing. The request will be processed in accordance with the applicable data protection law. The response to such a request may also be denied or limited in accordance with legal provisions.

If you wish to delete, correct or update personal information collected through the Web site, you will be able to do so by contacting us by e-mail. To protect your privacy and security we will take reasonable steps to verify your identity before granting access or making such deletions, corrections or updates.

Finally, the person whose data is being processed has the option under the Federal Data Protection Act to contact the Federal Data Protection and Information Commissioner (www.edoeb.admin.ch).

A change in this Data Protection Notice may be necessary, for example, if there is a change in legislation or a change in the way personal data is processed. In this case, it is planned to publish the new version on the Food Trip Go website: www.foodtripgo.com .

Continued membership or continued use of the site by you implies your acceptance of the policy, in its revised versions from time to time.
